This website is operated by Delta Prep Inc. Throughout the site, the terms “Delta Prep”, “we”, “us” and “our” refer to Delta Prep. Delta Prep offers this website, including all information, tools, and educational services ("Services") available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site or registering for our tutoring programs, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”). These Terms apply to all users of the site, including without limitation browsers, students, parents/guardians, and contributors of content.
Please read these Terms carefully. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all terms, you may not access the website or use our Services.
SECTION 1 – ELIGIBILITY AND PARENTAL CONSENT
By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence. If you are a student under the age of 18, you may only use our Services with the involvement and express consent of a parent or legal guardian.
We do not knowingly collect data from children under 13 without verifiable parental consent. If we learn that we have collected personal information from a child under 13 without parental authorization, we will delete that information immediately.
SECTION 2 – CODE OF CONDUCT
You agree to use our Services only for lawful and educational purposes. You are prohibited from:
Engaging in any behavior that disrupts the learning environment for other students or tutors.
Using bullying, harassment, or discriminatory language based on race, ethnicity, religion, gender, sexual orientation, or disability.
Attempting to bypass site security or transmitting viruses/malicious code.
Sharing account access or proprietary curriculum materials with unauthorized third parties.
A breach of this Section may result in the immediate termination of your access to Delta Prep programs.
SECTION 3 – ACADEMIC DISCLAIMER
Delta Prep provides tutoring and resources for the Specialized High Schools Admissions Test (SHSAT). While we strive for excellence, Delta Prep does not guarantee specific score improvements, placement in any particular school, or any specific academic outcome. All educational materials are provided "as is" for informational purposes. Reliance on the materials provided by Delta Prep is at your own risk.
SECTION 4 – MODIFICATIONS TO SERVICES
We reserve the right to modify, suspend, or discontinue any tutoring program, resource, or part of the Service at any time without notice. We shall not be liable to you or any third party for any such modifications.
SECTION 5 – ACCURACY OF INFORMATION
While we aim to provide the most up-to-date information regarding the SHSAT and NYC Department of Education policies, we are not responsible if information on this site is inaccurate or outdated. It is your responsibility to verify testing dates and requirements with official Department of Education sources.
SECTION 6 – THIRD-PARTY LINKS & TOOLS
We may provide access to third-party tools (such as video conferencing software or practice testing platforms). You acknowledge that these are provided “as is” and your use of them is governed by those third parties' respective terms and privacy policies. We are not liable for any harm or damages related to your use of third-party websites or resources.
SECTION 7 – INTELLECTUAL PROPERTY
Unless otherwise stated, all curriculum, practice problems, and website content are the property of Delta Prep Inc. You may not reproduce, duplicate, copy, or sell any portion of the Service without express written permission from us.
SECTION 8 – LIMITATION OF LIABILITY
In no case shall Delta Prep, our directors, officers, volunteers, interns, or affiliates be liable for any injury, loss, claim, or any direct or indirect damages arising from your use of our Services. This includes, but is not limited to, technical errors or the inability to access our digital classroom. Our liability shall be limited to the maximum extent permitted by law in the State of New York.
SECTION 9 – INDEMNIFICATION
You agree to indemnify and hold harmless Delta Prep Inc. and our volunteers and partners from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law.
SECTION 10 – GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
SECTION 11 – TERMINATION
We reserve the right to refuse or terminate Service to anyone for any reason, particularly in cases of misconduct or violation of these Terms, at any time without notice.
